The owners of the Nantucket, Chesapeake, and Lexington/New Hampshire strata schemes, the Phillip Street and Jacaranda Drive residences, the Jacaranda Drive townhouses, and the Rosemeadow Drive townhouses combine together to form the Cape Cabarita Community Association.


Association

In accordance with the Community Land Management Act (2021) the Association is responsible for managing the Cape Cabarita Scheme, including its finances, accounts, insurances and records, and by controlling the use of its property and facilities, and undertaking necessary replacements, repairs, and maintenance to them, ensuring a safe enviroment, continuing functionality, and the preservation of the Scheme’s architecture and landscapes.


The Community Management Statement is a set of by-laws and plans that regulate the management and operation of the Community Scheme, in conjunction with the Community Land Management Act 2021.

The Community Association, each Subsidiary Body and each Owner or Occupier of a Lot must comply with the Community Management Statement.

If there is an inconsistency between any by-law in the Community Management Statement and a Subsidiary Body by-law, the terms of the by-law in the Community Management Statement will prevail.


Essence of the Scheme

The Community Association, assisted by the Association Committee, has a statutory obligation to maintain and preserve the essence of the original scheme.

The architectural and landscape standards, listed in the annexures to by-law 2, define, to a degree, the Essence.

The Association Committee, by resolution, may impose additional conditions on, or not approve, any addition or alteration proposed by an owner it determines is not in keeping with the essence of the original scheme.


Association Committee

The Association Committee assists the Community Association by undertaking administrative functions pursuant to the Community Land Management Act 2021 and the by-laws detailed in the Community Management Statement.

The Association Committee currently consists of eight (8) elected representatives, one from each strata scheme, two from the residences, two from the Rosemeadow Drive townhouses, and one from the Jacaranda Drive townhouses.

Association Committee Meetings

The Association Committee meets approximately every month in the Community Room. The link connects to a schedule of meetings.

All members of the Association are entitled to attend these meetings but may only speak with prior notice and with the approval of the Committee.

The Annual General Meeting is held approximately October-December each year. Other General Meetings are scheduled when required.

The Association Committee has engaged, under contract, a company to provide Estate (Facilities) management services.

The primary function of the Estate Manager is to keep Community property and facilities in good order and repair.

Other functions include attending to emergencies affecting Community property and facilities, including after hours emergencies, coordinating and supervising the activities of contractors engaged by the Association to undertake works and provide services, and inducting new residents.

The Facilities Manager resides on site, and maintains an office that is open during working hours to assist and advise residents on Estate related matters.


The Association Committee has entered into a number of contracts to assist with the management of the Scheme, and the Estate, and to provide services, and works, that are necessary to maintain Community property and facilities to a very high standard in respect to safety, function and aesthetics.
