
About living on the Cape Cabarita Estate
The Cape Cabarita Estate is a unique, quiet, and safe place to live, on a ‘cape’ between France and Exile bays, with one road in (and out), with private properties and apartments that are maintained to an high standard, located among well maintained and kept gardens, and with ready access to a range of quality Community owned facilities, including 3 pools, 2 tennis courts and a gymnasium.
The Estate is managed in accordance with NSW Community Land Management Act by a Community Association, meaning that the owners, the members of this Association, manage the Estate.
The owners have a legal obligation to contribute to the maintenance of the Estate’s Community property, (by the payment of a quarterly levy), but also to maintain their own properties to the same high standard and, at all times, to conduct themselves in accordance with the expectations and requirements of the Association’s by-laws, rules and conditions.
Association committee
Cape Cabarita Community Association is assisted in the management of the Estate, (and the Community property that belongs to all the members of the Association), by an elected (volunteer) committee, known as the Association committee.
The Committee meets regularly, (approximately every 2 months), and all members of the Association are entitled to attend and, with prior approval, address the Committee on any issue related to the condition and/or management of the Estate.
Estate manager
The Association committee engages an Estate manager, under contract, to undertake the day to day management of matters related to the repair and maintenance of the Associations (Community) property.
The Estate manager also assists the Committee with the administration of the Association’s by-laws, rules and conditions, applicable to all residents living on the Estate, to ensure that they are understood and complied with.
The Manager is authorised by the Committee, on behalf of the Association, to issue directions to resident/s to ensure compliance.
The Estate manager lives on site, at 47 Phillip St, and the associated office is open for enquiries and to provide general assistance to residents between the hours of 8 am and 4 pm, Monday to Thursday, and from 8 am to 12 pm on Fridays. The Estate manager is also available, after hours, to attend to an emergency situation impacting on Community property.
Security
Although rare, break-ins on the Estate have occurred, accordingly it is recommended that accessible doors and windows are kept locked when you are not at home.
In respect to security generally, if you notice anything of concern, please notify the Estate Manager. If it is urgent, or life threatening, please call the Police on the emergency number 000.
Resident obligations
The Community is governed by a set of by-laws, rules and conditions, that all residents have a legal obligation to comply with them. The by-laws are detailed in the Cape Cabarita Community Management Statement, a copy of which can be downloaded here. Rules and Conditions are listed separately and can be downloaded here and here.
The following outlines, in brief, the main obligations all residents living on the Estate:
Property maintenance
Owners must maintain their homes in good order and ensure that external cleaning and repairs are made promptly when required.

Alterations and additions

Alterations and additions to your property must be designed, and installed, (after Committee approval), in compliance with the Association’s by-laws and architectural and landscape standards.
Approval may also be required, (of a development application), by the City of Canada Bay Council. Council approval does not mean that the proposed alteration or addition will be, or must be, approved by the Association.

If you require advice on the by-laws and/or standards, and what may or may not be approved please consult with your precinct representative or the Estate manager.
Moving in and moving out

If you, or your tenant, is moving into, or out of, your apartment the Strata’s Common areas must be protected.
The carpet cover must be laid in the foyer, and the lift covers must be hung.
Please contact the Estate Manager 3 business days prior to any move, or furniture delivery, to arrange supply of the lift covers).
When you leave Cape Cabarita, please remember to have your mail forwarded to your new address, and advise your Strata secretary and the Estate manager of your new address.
If you receive mail at your new address addressed to the previous resident, and do not know where to send it, please forward to the Strata secretary or Estate Manager.
Selling or leasing
Displaying of for-sale signs on the Estate is not permitted.
Residences, townhouses, and apartments for sale may be listed on the Association’s social media sites and newsletter.

Noise

Do not let any excessive noise, bad language, or any other inappropriate behaviour by you, or your guests, interfere with your neighbours, or other residents, and their right to enjoy living on the Estate in peace and quiet.
Drying clothes
Clothes are not permitted to hung for drying on any balcony or in an external (visible) yard.

Pets

Pets are permitted, (see by-law 28), but must be managed to ensure that they do not, eg, bark excessively or roam, unleashed, within the Estate.
Due to the extent of wildlife on the Estate, the mangroves, and within the adjacent park, cat owners should not allow them to roam free at night.
Car parking, washing and maintenance
Jacaranda Drive and Rosemeadow Drive are private roads, however as public access is permitted, NSW road laws apply.
All road signs must be complied with, noting 15 km/hr is the limit n both roads and the Jacaranda loop road is one way.
You are not permitted to park your car/s for extended periods in the designated visitor car parks. There are unrestricted public parking spaces on Phillip Street.
Cars parked on your driveway must not protrude onto the adjacent road.
There are three car washing bays. Cars may only be parked in these bays whilst they are being washed.
Engines, and mechanical parts, must not be cleaned in these bays as waste, (oil contaminated), water is not contained.
Maintenance work on your car must not be undertaken within the areas of the visitor car parks or the car washing bays.
Access to Community property must not be obstructed by cars at any time.

Use of Community facilities

Living on the Cape Cabarita Estate requires that Community’s facilities are used in compliance with the by-laws and rules established by the Association for their use, and with due consideration and respect for all other residents.
Residents need to register with the Estate Manager to obtain security keys, (2), to open gates and doors leading to Community property and facilities, and also obtain an activated access control fob, (1), for the gym.
Keys and/or fob must not be loaned to other than a family member or guest staying at your residence.
The Commitee may withdraw the right to keys, and the fob, if there are repeated breaches of the Association’s rules.
Guests, and small children, are not permitted to use the Community’s facilities unless they are accompanied by an adult resident. The Estate Manager has the right to ask anyone on Community property, or using Community facilities, to leave if they are not accompanied.
Replacements for lost or damaged security keys or gym fobs can be provided at cost to the owner or tenant that requires a replacement to be issued. Keys and the gym fob must be returned to the Estate Manager when your property is sold or a lease ends.
Community room

The Community room may used by any resident for a meeting with friends, and for more organised and regular activities.
The room may also be used for a private function for a resident and their guests, subject to compliance with the Association’s rules for it’s private use and an approved booking.
Gymnasium
- The gym is open from 5 am to 10 pm each day.
- Children under the age of 12 years are not permitted to use the gym. Children aged from 12 to 16 may if accompanied by an adult.
- Residents are permitted to bring two guests, and may use the services of a qualified and insured personal trainer.
- Users must be appropriately attired. Equipment can be used for 30 minutes, and must be reset and wiped down after use.
- If you are the last person to leave the gym please ensure all doors are locked and electrical equipment, eg, the a/c, is turned off.

Gazebos & BBQs

The gazebos and BBQs can be used by residents and their guests. Bookings must be made on sheets kept in the Community room.
Tennis courts
- Courts can be used during daylight hours, from 7 am, except on Sunday, when play cannot begin before 8 am.
- The courts must be booked. Booking sheets are kept in the Community room.
- Bookings may be made for 1 hour only, noting that you may continue to play on if the court you are using has not been booked for the following hour.
- Tennis shoes and appropriate clothing are required to be worn. Games using other than a tennis ball are not permitted. Scooters, skates and bicycles are not permitted on courts.

Swimming pools, spas, sauna and steam room

- Hours are from 6 am to 9 pm.
- Children under 12 must be accompanied by an adult.
- Glass, eg, glasses and bottles, are not allowed within pool enclosures.
- Smoking is not permitted in the enclosures and association amenities.
- Pool gates must be kept closed at all times with the child proof locks activated.
- When using the lap pool, lap swimmers have right of way.
Protecting Your Interests When Leasing Your HomeIf you are an owner who leases or intends to lease your property, we need to draw some points to your attention.Cape Cabarita is a unique community that functions efficiently because residents are well known to each other. We take the view that tenants who move into Cape Cabarita do not just move into a home but a home in a community where they are invited to share the facilities and if they want, a social program.To make this work it is essential that any new tenants meet with the Estate Managers before moving in. The Estate Managers are here to welcome them to Cape Cabarita and inform them of what is available for them.Please inform the managing agent of these requirements when leasing your property. SECURITY
LIVING SOCIALLY WEBSITE, NEWSLETTER AND SOCIAL COMMITTEE
The Community has its own website which has some useful information and residents will receive a weekly newsletter. This may contain matters from the Executive committee, social club, Estate office or other residents that you may find useful, interesting or a bit of fun.Please make sure the Estate office is kept up to date with contact information for access to these features.The newsletter is produced voluntarily by our resident webmaster John Brownhill and any items you wish included can be sent to him at: jandmb75@gmail.comThe community also has a Social Committee that organises events throughout the year. Residents and their guests are encouraged to join in with these events. It is a great way to get to know your neighbours and become involved with the community.The committee is always looking for new members to help with the organisation of events for the community or perhaps with setting up for these events if you are unable to join the committee. CLASSESThroughout the year there are various fitness classes run by either an instructor (for a small fee) or free by other residents.These classes include:Exercise classes, which include a combination of Yoga & Pilates type exercises and are adjusted according to fitness and ability.Aqua Aerobics in the summer months from around October to MayQigong – a type of Tai ChiFor information on these classes please contact the Estate office or consult the newsletter. ACTIVITIESThere are several other activities such as ladies and mens tennis days, table tennis nights. etc. GENERAL INFORMATION WASTE COLLECTION
Garbage collection day is Friday, bins should be out Thursday evening.Red bin is collected every week, green and yellow alternate weeks.Council’s bulk household collection occurs bi-annually.Glass, plastic bottles, cans, and some tetra packs can be deposited in the “Return & earn” recycling unit in the carpark of Briars Sports Club, 14 Ian Pde. PUNT
Many new residents may not know that the Putney Punt provides a quick traffic-free link between Mortlake and Putney, providing you know when it runs. It is basically a weekday peak time and weekend service. Departure times from Mortlake are:Monday to Friday (continuous)Morning: From 6.20am to 9.25amAfternoon: From 2.20pm to 5.25pmSaturday, Sunday and HolidaysContinuous 10.00am to 5.00pmExtra trips are often run, but don’t count on it. Return trips are 5 minutes later than those above. Please note that these times may be varied by the RTA at any time. THE CITY OF CANADA BAY PARKING PERMITSThe Canada Bay Council issues free parking permits that will enable you to have unlimited parking in Bayview and Cabarita Park.Being able to use it at the latter is handy for parking when you use the Rivercat to the city.To obtain one of these go to the Councils Civic centre at 1a Marlborough Street Drummoyne (8.30am to 4pm weekdays) and produce your driver’s licence and registration papers. There are some residents who are JPs and are willing to assist you if you should require their service to witness document execution etc. They are listed on the Estates website. Apartment owners should ensure that all tags and keys have been returned to the agent on completion of the lease period or sale of the property.
Apartment residents are asked to ensure that the building front doors are always kept locked. In some wind conditions the self-closers do not work to close and secure the doors.
